This sales contract entered into on this ______ day of _______, in the year of _____, between Pauline Thompson or Heather Oleson (hereinafter referred to as “Seller/Breeder”) and ______________________ (hereinafter referred to as “Buyer”).
For and in consideration of the sum of $ ________, such being the purchase price and all mutual promises contained herein Seller/Breeder agrees to and does hereby deliver and transfer ownership to Buyer of a Shih Tzu puppy, female / male of pet, companion quality.
This puppy’s health is guaranteed to be good to the best of our knowledge at the time of sale and has had a routine health examination by a licensed veterinarian. Buyer will have the puppy examined by a licensed veterinarian within 48 hours of delivery and is urged to do so.
It is agreed and understood that this puppy has not been purchased for resale or for use by any wholesale operation. The Seller/Breeder has the right to have the first choice of resale and shall be informed before any other contacts are made. Buyer agrees that if for any reason, the new puppy does not work out, the puppy is to be returned to Seller/Breeder only and never to a pet store, dog farm, puppy mill, wholesaler, agent, or the pound. Buyer agrees that puppy is part of your family and is not to be kept outside in the elements, or on a chain … a Shih Tzu is a house pet, and should be treated as such.
TopKnot Shih Tzu’s are guaranteed against any genetic (inherited) life-threatening medical condition that is properly diagnosed by a licensed veterinarian and substantiated with proper testing, within the first 2 years of life. Seller/Breeder shall be notified immediately via telephone and in writing within 48 hours of diagnosis. Seller/Breeder reserves the right to request a second opinion by another veterinarian at the Buyer’s expense. It is suggested that you feed a high quality dog food like (Iams, Eukanuba, Bil Jac) a healthy dog is a happy dog and owner!
In the event a life-threatening medical condition proven to be genetic (inherited) occurs within first two years of puppy’s life, Seller/Breeder will replace the puppy with one of equal or greater value at earliest availability. Selection of replacement will be made by Seller/Breeder. Seller/Breeder reserves the right to make the decision as to whether the puppy is returned to Seller/Breeder, or allowed to remain with Buyer.
This contract is null and void if the new owners do not have the puppy examined by a licensed veterinarian within 48 hours of delivery!!
In the event a dispute should arise concerning this contract that cannot be resolved by Seller/Breeder or Buyer, or if any part of this contract is not adhered to, the guarantee is null and void. Any legal action instigated by Buyer relating to the treatment of this animal will be the sole financial responsibility of Buyer and shall be filed in Saline County, Arkansas.
Any further conditions for this sale shall be as follows. Seller/Breeder guarantees veterinarian check, first shots and deworming.
ADDITIONAL TERMS:
All puppies are sold on a Limited Registration ( can not be used for breeding) Puppy shall be spay/neutered on or before 6 months of age. Proof of spay/neuter shall be sent to breeder as soon as completed. When proof is provided you will then receive your AKC puppy registration papers.
Shipping shall be considered for an additional cost. Checks will be accepted as down payment. Final payment is due 1 week before shipping or on day of pickup. This payment is to be CASH or CASHIER CHECK ONLY. SORRY NO EXCEPTIONS.
This contract contains the entire agreement between the parties and no statement, promises, or inducements made by either party that is not contained in the written contract shall be valid or binding. This contract may not be modified or altered except in writing signed by both parties and endorsed herein.
I agree with the above contract and will hereby abide by the stipulations aforementioned.
